2021 review of cinematic production obligations

Arcom has examined the declarations of 20 publishers or groups of publishers subject to contribution to cinematic production obligations for the 2021 financial year.
Following this examination :
- the Authority has decided, in the case of Canal+, to take account of the terms of the settlement agreement between Canal Plus Group and the organizations representing the film industry, which includes an additional commitment by Canal+ to invest €32 million in pre-purchases of original French-language independent cinematographic works, on condition that the agreement remains in force until its expiry and is complied with;
- in the case of TF1, and under the provisions of the agreement signed on July 16, 2021 between the TF1 group and the organizations representing the film industry, the Authority has agreed to carry over to 2022 the deficit and surpluses recorded in 2021, while specifying to the service editor that as of the 2022 financial year, the carryover of surpluses will no longer be possible due to the entry into force of the Decree of December 30, 2021 on the contribution to the production of cinematographic and audiovisual works by terrestrially broadcast television services;
- in the case of OCS, under the provisions of the agreement signed on February 9, 2022 between the Orange Group and organizations representing the film industry, it has agreed to defer until December 31, 2024 the deficits recorded in 2021.
