2023 pay-TV channel report: examination of compliance with obligations to broadcast works (wave 2)

Arcom has examined compliance by the publishers of 32 pay-TV services with their obligations to broadcast works for the 2023 financial year.

Following this examination, the Authority :

  • intervened with the publisher of the Pitchoun TV service, asking it to comply in future with the provisions of Article 17 of the European Audiovisual Media Services (AVMS) Directive concerning the broadcasting of European works by independent producers;
  • warned the publisher of the Autoplus TV, Gourmand TV, Top Santé TV and Maison et Travaux TV services of repeated breaches, firstly of its contractual obligations to provide Arcom with a report on the conditions of performance of the obligations and commitments concerning the programs of each of the services, and secondly of the provisions of articles 16 and 17 of the AVMS Directive concerning the broadcasting of European works, including those by independent producers.
