Arcom has examined compliance by the publishers of 32 pay TV services with their obligations to broadcast works for the 2023 financial year.

Following this review, the Authority decided to :

  • to ask the publisher of Pitchoun TV to comply in future with the provisions of Article 17 of the European Audiovisual Media Services Directive ("AVMS Directive") concerning the diffusion of European works by independent producers;
  • to warn the service editors of Autoplus TV, Gourmand TV, Top Santé TV and Maison et Travaux TV against repeated breaches, on the one hand, of its contractual obligations to provide a report on the conditions of performance of the obligations and commitments concerning the programs of each of the services and, on the other hand, of the provisions of articles 16 and 17 of the AVMS Directive relating to the diffusion of European works, including those originating from independent producers.
