Arcom examined the compliance of 17 pay TV service editors (4 cinema channels and 13 non cinema channels) with their obligations to broadcast works for the 2023 financial year.

Following this examination, the Authority found that the Mélody d'Afrique service had a 7-point shortfall (53% instead of 60%) in its quota for the diffusion of European audiovisual works, and a 12-point shortfall (28% instead of 40%) in its quota for the diffusion of original French-language audiovisual works (EOF) over total diffusion time, contrary to article 13 of the decree of January 17, 1990.

It also found that the channel had devoted only 1% of its total broadcasting time to European works by independent producers of radio broadcasting organizations to recent works, in compliance with article 17 of the European Audiovisual Media Services Directive (AMS).

As a result, Arcom has warned the service editor against repeating the breach of its diffusion quota for European and EOF cinematic works. Arcom also demanded that the service provider ensure compliance with article 17 of the AVMS directive, which is enshrined in its agreement.
