Arcom was alerted following the diffusion, in the program Affaire suivante on February 16, 2025 on BFM TV, of a photo of a person under 18 to illustrate a documentary on an ongoing court case.

It found that the image in question, which showed a person other than the suspect in question, reflected a lack of appropriateness between the context in which it was used and the subject it was intended to illustrate, moreover in the context of a particularly dramatic case, characterizing a breach of the provisions of article 2 of the deliberation of April 18, 2018.

It also considered that the sequence characterized an infringement of the image rights, honor and reputation of this person, in disregard of the provisions of article 2-3-4 of the channel, as the photograph of the minor had been shown without the consent of his or her legal representatives.

As a result, the Authority warned the service editor to ensure strict compliance with the aforementioned obligations in the future.
