In a decision dated December 31, 2024 (no. 484422), the Conseil d'Etat upheld the legality of the financial penalty of 120,000 euros imposed on June 21, 2023 (decision no. 2023-544) by Arcom on C8, ruling that this amount was not disproportionate in view of the seriousness of the breaches concerned and their repetition (mentioned in points 4 to 7 of the aforementioned Arcom decision).

On the other hand, the Conseil d'Etat decided to amend the 80,000 euro penalty imposed on C8 (for the facts mentioned in points 11 to 13 of the aforementioned Arcom decision), reducing it to 60,000 euros, due to an error of assessment relating to facts concerning the wearing, by a guest, of a sweatshirt bearing the logo of a cryptocurrency exchange platform. The Conseil d'Etat ruled that this did not constitute surreptitious advertising, since the logo had " been concealed for most of the sequence and only appeared occasionally, in the last six minutes, on the bangs of frames centered on the guest's bust ".
