The Authority considered that while these remarks may have shocked some viewers, they did not exceed the limits of freedom of expression. Indeed, in accordance with the case law developed by the European Court of Human Rights since the Handyside v. United Kingdom judgment of December 7, 1976, this freedom applies "not only to information or ideas that are favorably received or regarded as inoffensive or as a matter of indifference, but also to those that offend, shock or disturb the State or any section of the population".
Consequently, the Authority did not intervene against the service editor.
