La Bande originale" show broadcast on February 12, 2023: response to the plaintiffs
Arcom was alerted to a segment of the program La Bande originale, broadcast on France Inter on February 12, 2023, during which transphobic remarks were allegedly made.
It considered that the disputed remarks did not exceed the limits of freedom of expression, of which it is the guarantor. In accordance with the case law developed by the European Court of Human Rights since the Handyside v. United Kingdom judgment of December 7, 1976, this freedom applies "not only to information or ideas that are favourably received or regarded as inoffensive or as a matter of indifference, but also to those that offend, shock or disturb the State or any section of the population".
Consequently, the Authority did not intervene against the service editor.
