Arcom was alerted to the Le Live Toussaint show, broadcast on June 19, 2023 on BFM TV, during which the presenter made statements concerning the incidents that occurred in Brest on June 17 on the sidelines of a book signing for Éric Zemmour.

It ruled that the comments made by the journalist, who strongly condemned all forms of violence, could not be considered as inciting dangerous, delinquent or uncivil behavior, and that they did not exceed the limits of freedom of expression.

According to the long-standing case law of the European Court of Human Rights, freedom of expression applies " not only to information or ideas that are favourably received or regarded as inoffensive or as a matter of indifference, but also to those that offend, shock or disturb the State or any section of the population ".

Consequently, the Authority did not intervene against the service editor.
