Programmes shown as part of the official campaign for the 2022 presidential election: responses to the plaintiffs
Arcom was alerted following the diffusion, on April 5, 2022 on France 2, of one of the campaign modules by Mr. Philippe Poutou and Mr. Éric Zemmour, as part of the official audiovisuel campaign for the election of the President of the Republic.
It considered that the diffusion of these modules, which fall within the scope of political discourse, did not infringe its decision of March 2, 2022 relating to the conditions of production, programming and diffusion of campaign broadcasts for the election of the President of the Republic for the first and second rounds of voting.
It recalled that, according to the established case law of the European Court of Human Rights, freedom of expression applies " not only to information or ideas that are favorably received or regarded as inoffensive or as a matter of indifference, but also to those that offend, shock or disturb the State or any section of the population".
Under these conditions, the Authority did not intervene.
