Arcom was alerted following the diffusion, on July 10, 11 and 13 2023, on CNews in the programs L'heure des pros, Punchline and Face à l'info, of sequences relating to statements made by the French Minister of Education.

In accordance with the case law developed by the European Court of Human Rights since the Handyside v. United Kingdom judgment of December 7, 1976, according to which freedom of expression applies "not only to information or ideas that are favourably received or regarded as inoffensive or as a matter of indifference, but also to those that offend, shock or alarm the State or any section of the population ", and considering that a political figure is by nature exposed to criticism, the Authority did not find any elements likely to constitute an infringement of personal rights or to disregard the limits of freedom of expression.

Consequently, the Authority did not take any action against the service editor.
