Ruth Elkrief 2022" show broadcast on September 27, 2021: reply to the plaintiffs
The French Superior Audiovisual Council (French Superior Audiovisual Council), which became the French regulatory authority for audiovisual and digital communication (Arcom) on January1, 2022, was alerted to comments made in the Ruth Elkrief 2022 program shown on LCI on September 27.
It noted that these comments were part of a general-interest debate on France's migration policy. While they may have been considered shocking by some viewers, it did not seem to him, in view of the exchanges as a whole, that they exceeded the limits of freedom of expression, which applies " not only to information or ideas that are favorably received or regarded as inoffensive or as a matter of indifference, but also to those that offend, shock or disturb the State or any section of the population " (ECHR, Handyside v. United Kingdom, December 7, 1976, no. 5493/72).
Moreover, these comments were shut down by the host and her guest.
Consequently, the Council did not find the publisher in breach of its obligations.
