Arcom was alerted to comments made by Mr. Cyril Hanouna during the program Touche pas à mon poste! shown on October 9, 2023 on C8.

It noted that these brief statements were made in the context of a public controversy that was widely covered by the media, allowing for greater freedom of expression. It considered that they were not of a nature to characterize incitement to hatred and violence, nor to dangerous, delinquent or uncivil behavior towards members of the La France Insoumise party.

In addition, it did not find any elements likely to characterize a breach of the requirement for honesty of news provided for in article 1 of the deliberation of April 18, 2018 relating to the honesty of news and the news programmes that contribute to it.

Arcom points out that, in accordance with the established case law of the European Court of Human Rights, political figures must, by nature, show greater tolerance of criticism, and that it falls within the natural competence of the judicial judge to rule on the defamatory nature, where appropriate, of the reported remarks.

Consequently, the Authority did not intervene against the service editor.
