The matter was referred to the Council concerning an advertising message for a car brand, broadcast on radio and television. The complainants questioned the use of the melody of La Marseillaise, mainly in the form of sound effects.

The Conseil considered that the use of La Marseillaise in this case was simply a reference to the French origin of the car's production, which the brand wished to promote for this series, which bears the name "France", and that neither article 2 of the decree of April 6, 1987, nor article 3 of the decree of March 27, 1992, which govern commercial communications, had been disregarded.

The Conseil responded accordingly.
