Arcom notice of March 6, 2024 to radio and television services for the election of representatives to the European Parliament on June 8 and 9, 2024
The French regulatory authority for audiovisual and digital communication,
Having regard to the electoral code ;
Having regard to Act no. 77-729 of July 7, 1977, as amended, relating to the election of representatives to the European Parliament;
Having regard to Act no. 86-1067 of September 30, 1986, as amended, on freedom of communication;
Having regard to decree no. 79-160 of February 28, 1979 enforcing law no. 77-729 of July 7, 1977 relating to the election of representatives to the European Parliament;
Having regard to deliberation n° 2011-1 of January 4, 2011 relating to the principle of political plurality in radio and television services during election periods;
Having regard to deliberation no. 2017-62 of November 22, 2017 relating to the principle of political plurality in radio and television services;
Having regard to deliberation no. 2018-11 of April 18, 2018 relating to the honesty and independence of news and the programs that contribute to it;
After deliberation;
Adopts the following notice:
On January 4, 2011, the French Superior Audiovisual Council adopted a resolution applicable to radio and television services during election periods. The present notice supplements this deliberation for the election of representatives to the European Parliament on June 8 and 9, 2024.
It applies to all radio and television services, whatever their broadcasting method by any electronic communication process, from Monday April 15, 2024 until the day on which the election is won.
It does not apply to services which, exclusively accessible via online public communication, are dedicated to the electoral propaganda of lists of candidates or the political parties and groupings which support them.
I. Treatment of election-related news
1. In accordance with the aforementioned deliberation of January 4, 2011 on the principle of political plurality in radio and television services during election periods, since the territory of the Republic constitutes a single electoral district, providers of radio services ensure that lists of candidates and their supporters benefit from equitable presentation and access to airtime.
2. In its assessment of compliance with the principle of fairness, the Authority takes into account the representativeness of the lists of candidates and the political parties and groupings that present or support them, measured, in particular, on the basis of the results obtained at the last election of representatives to the European Parliament and at the most recent elections, and on the basis of indications from opinion polls; the Authority also takes into account the contribution made by each of the lists of candidates and their supporters to stimulating the electoral debate.
3. In accordance with the aforementioned deliberation of January 4, 2011 on the principle of political plurality in radio and television broadcasting during election periods, the reports, commentaries and presentations to which the elections give rise must be presented with a constant concern for moderation and honesty.
II. List of speeches
1. Publishers must record the speaking times of lists of candidates and their supporters throughout their programs.
2. Interventions by nationals of European Union member states other than France are taken into account if they are candidates in France or if these interventions express support for a list of candidates in France.
3. The times recorded are accumulated from Monday April 15, 2024 up to and including the Friday preceding polling day, with the exception of Guadeloupe, French Guiana, Martinique, French Polynesia, Saint-Barthélémy, Saint-Martin and Saint-Pierre-et-Miquelon, where they are accumulated up to and including the Thursday preceding polling day.
III. Transmission and publication of statements of intervention
1. The following editors or services shall electronically transmit to the Authority the breakdown of speaking times for lists of candidates and their supporters as recorded in their programs
- TF1 ;
- France Télévisions (France 2, France 3 for its national program, France , franceinfo:) ;
- Canal+ for its free-to-air programs ;
- M6 ;
- BFM TV ;
- CNews ;
- LCI ;
- C8 ;
- TMC ;
- RMC Découverte ;
- RMC Story ;
- France 24 ;
- TV5 Monde for its own programs;
- Euronews ;
- Radio France (France Inter, France Info, France Culture) ;
- Radio France Internationale ;
- RTL ;
- Europe 1 ;
- RMC ;
- BFM Business ;
- Radio Classique ;
- Sud Radio.
2. For each period mentioned below, speaking times are transmitted on the following dates:
- Period from April 15 to April 28 - Transmission date April 29.
- Period from April 15 to May 12 - Transmission date May 13.
- Period from April 15 to May 19 - Date of transmission May 20.
- Period surveyed from April 15 to May 26 - Transmission date May 27.
- Period surveyed from April 15 to June 2 - Transmission date June 3.
- Period surveyed from April 15 to June 7 - Transmission date June 10.
Times are cumulated over the entire period concerned on each transmission date.
3. At the Authority's request, other publishers will transmit data relating to the speaking times of lists of candidates and their supporters in accordance with the conditions, in particular frequency and format, determined by the Authority.
IV. Transmission of information relating to submissions of a case before the court
Radio and television services shall provide the Authority, at its request, with all information required to investigate any submissions of a case before the court.
V. Retention and transmission of other information
Publishers shall keep audio and video recordings of programmes shown during the period covered by the present notice, and shall make them available to the Authority on request.
VI. News not related to the election
With regard to the coverage of non-election-related news, radio and television services continue to apply the aforementioned deliberation of November 22, 2017 on the principle of political plurality.
VII. General schemes
The present notice is applicable in New Caledonia, French Polynesia, Wallis and Futuna and the French Southern and Antarctic Territories. It will be published in the Official Journal of the French Republic.
