Recommendation no. 2013-02 of February 26, 2013 from the French Superior Audiovisual Council to radio and television services shown in French Polynesia in view of the election of members of the Assembly of French Polynesia on April 21 and May 5, 2013
The French Superior Audiovisual Council,
Having regard to the Electoral Code, in particular Book V;
Having regard to Organic Law no. 2004-192 of February 27, 2004 on the autonomous status of French Polynesia;
Having regard to Organic Law no. 2007-1719 of December 7, 2007 aimed at strengthening the stability of institutions and the transparency of political life in French Polynesia;
Having regard to Organic Law no. 2007-1720 of December 7, 2007 aimed at strengthening institutional stability and political transparency in French Polynesia;
Having regard to Law no. 86-1067 of September 30, 1986, as amended, on freedom of communication, in particular articles 1, 13 and 16;
Having regard to Decree no. 2013-74 of January 24, 2013 convening the electorate for the renewal of the Assembly of French Polynesia;
Having regard to deliberation no. 2011-1 of January 4, 2011 relating to the principle of political plurality in radio and television services during election periods;
Having regard to the letter dated February 15, 2013 from the French Superior Audiovisual Council browsing the Government of French Polynesia;
After deliberation,
Adopts the following notice:
The French Superior Audiovisual Council adopted on January 4, 2011 a deliberation applicable to radio and television services during election periods, which applies during the six weeks preceding election day. The present notice supplements this deliberation.
It applies to all radio and television services shown in French Polynesia from March 11, 2013.
1. Counting and transmitting statements of speaking time
France Télévisions, for the Polynésie française 1re service (radio and television), and Tahiti Nui Télévision will electronically record and transmit to the French Superior Audiovisual Council the speaking times of the lists of candidates and their supporters on a weekly basis, in accordance with the following conditions.
For the period preceding the first round of voting :

Local radio stations transmit to the French Superior Audiovisual Council, at its request and for the period it specifies, all information relating to speaking time in connection with the election.
2. Retention and transmission of other information
The French Polynesia 1re service and the Tahiti Nui Télévision company, as well as local radio stations, shall keep audio or video recordings of programs shown during the period covered by the aforementioned deliberation no. 2011-1 and, where appropriate, communicate them to the French Superior Audiovisual Council.
This notice will be published in the Journal officiel de la République française and the Journal officiel de la Polynésie française.
