French Superior Audiovisual Council's contribution of March 19, 2013 to the consultation of interested third parties on the reference supplies proposed by the Canal Plus Group in execution of the injunctions imposed by the Authority in connection with the authorization of the acquisition of exclusive control of TPS and CanalSatellite.
On July 23, 2012, the Competition Authority authorized the acquisition of TPS and CanalSatellite by Vivendi Universal and Groupe Canal Plus, subject to compliance with injunctions designed to establish sufficient competition on the pay-TV markets.
In its May 2, 2012 opinion to the Autorité, the French Superior Audiovisual Council had deemed it necessary to maintain obligations relating to the take-up and carriage of independent channels in CanalSat supplies and to the provision to internet service providers of all cinema channels edited by the Canal Plus group. It had also expressed the wish that the Canal Plus group be obliged to publish reference supplies for the implementation of these two obligations, in order to improve the transparency of commercial relations.
The Competition Authority included these obligations in its injunctions. To implement them, it opened a consultation of interested third parties on the draft reference supplies on March 4, 2013. The Conseil forwarded observations to the Competition Authority, which were adopted by the full college on March 19, 2013.
