Decree no. 2011-47 of January 11, 2011 on the transnational application of the provisions of article L. 333-7 of the French Sports Code and article 20-4 of law no. 86-1067 of September 30, 1986.

The Prime Minister,

On the report of the Minister for Culture and Communication and the Minister for Sport,

Having regard to Directive 2010/13/EU of the European Parliament and of the Council of 10 March 2010 on the coordination of certain provisions laid down by law, regulation or administrative action in Member States concerning the provision of audiovisual media services, and in particular Article 15 thereof;

Having regard to the French Sports Code, in particular article L. 333-7;

Having regard to Law no. 86-1067 of September 30, 1986, as amended, on freedom of communication, in particular articles 2 and 20-4;

Having regard to the opinion of the French Superior Audiovisual Council dated November 4, 2010;

Le Conseil d'Etat (section de l'intérieur) entendu,

Decree:

Article 1

Chapter III of Title III of Book III of the regulatory section of the French Sports Code is amended as follows:

1° A new section 1 is created, entitled "Operating rights" and comprising articles R. 333-1 to R. 333-3;

2° A new section 2 is added, as follows:

"Section 2

"Freedom of diffusion

"Art. R. 333-4. - Brief extracts of a sports event or competition broadcast in application of article L. 333-7 are taken from the images of the rights holder established in France by any television service editor, for broadcasting on its airwaves or on its on-demand audiovisual media services that make the same program available for deferred broadcasting:

"a) If this publisher is established in France; or

"b) If the publisher is established in another Member State of the European Union or party to the Agreement on the European Economic Area and no publisher in that State has acquired the right of exploitation.

Article 2

The Minister of Culture and Communication and the Minister of Sports are each responsible for the execution of this decree, which will be published in the Journal officiel de la République française.
