Decree n°87-239 of April 6, 1987 taken for the application of article 27-I of the law n°86-1067 of September 30, 1986 relative to the freedom of communication and fixing for the private services of sound broadcasting diffused by terrestrial hertzian way or by satellite the regime applicable to publicity and sponsorship.

Article 1
Advertising and sponsorship for radio broadcasting services broadcast by terrestrial or satellite means, other than those provided by national program companies, are subject to the law.

Title I

Rules applicable to advertising messages

Article 2
The content of advertising messages must comply with the requirements of truthfulness, decency and respect for human dignity.
It must not damage the credit of the State.

Article 3
Advertising messages must be free of any racial or sexual discrimination, scenes of violence or elements likely to provoke fear or encourage abuse, carelessness or negligence.

Article 4
Advertising messages must not contain any element likely to offend the religious, philosophical or political convictions of listeners.

Article 5
Advertising must respect the interests of consumers. Advertising messages must not, directly or indirectly, by exaggeration, omission or ambiguity, mislead the consumer.

Article 6
Advertising must never exploit the inexperience or credulity of children and adolescents.
Children and adolescents may not be prescribers of the product or service being advertised. They may only be principal actors if there is a direct relationship between them and the product or service concerned.

Article 7
Commercials are shown in French.

Article 8
Advertising messages must be clearly announced and identified as such.

Article 9
Contributions from public or private companies wishing to finance programs to promote their image, activities or achievements are authorized, provided that the service retains full control over the programming of these programs.
The name, denomination or corporate name of the company may be quoted from time to time in sponsored programs, together with a list of the distinctive signs usually associated with it.

Provisions relating to sponsored programs

Article 10
Services are subject to the control exercised by the French Superior Audiovisual Council under article 14 of the law of September 30, 1986.
