General schemes

Article 1
The French Superior Audiovisual Council is convened by its President. The Chairman sets the agenda.

Article 2
The French Superior Audiovisual Council declares, by a two-thirds majority of its members, the compulsory resignation of any of its members who is prevented from carrying out his or her duties due to permanent incapacity. By the same majority, it shall declare the compulsory resignation of any member who has placed himself in a situation prohibited by the provisions of the fourth paragraph of article 51 of the amended law of September 30, 1986.

Article 3
When the term of office of a member is interrupted more than six months before its expiry date, for any reason whatsoever, the Chairman of the French Superior Audiovisual Council shall notify the appointing authority that it will have to designate a successor within twenty days of receipt of the notification.

Article 4
The French Superior Audiovisual Council shall issue rules of procedure governing its deliberations and the proceedings before it.

Article 5
Without prejudice to the provisions of article 100 of the amended Act of September 30, 1986, the Chairman of the French Superior Audiovisual Council may, with the agreement of the ministers concerned, summon the services of the State whose assistance is necessary for the accomplishment of its mission.

Article 6
The President of the French Superior Audiovisual Council is empowered to enter into agreements, whether free of charge or against payment, with any private or public entity.

Article 7
The President of the French Superior Audiovisual Council is the authorizing officer for the French Superior Audiovisual Council's income and expenditure.

Provisions relating to services

Article 8
The French Superior Audiovisual Council shall have departments, the organization of which shall be decided by its President, after consulting the Joint Technical Committee and the French Superior Audiovisual Council.
A decision by the Chairman shall, under the same conditions and with the agreement of the Minister responsible for the budget, lay down the rules governing the management of the Council's contract employees.

Article 9
Under the authority of the Chairman, the French Superior Audiovisual Council is headed by a Director General.

Article 10
The Director General is appointed by decree of the President of the Republic, on the recommendation of the President of the French Superior Audiovisual Council.
The President of the French Superior Audiovisual Council appoints other positions.

Article 11
The Director General attends the deliberations of the French Superior Audiovisual Council. He shall draw up the statement of offence and ensure its execution.
However, the Board may, at the request of a member and if it deems it useful, decide to meet in camera.

Article 12
The President of the French Superior Audiovisual Council may delegate to the French Superior Audiovisual Council the power to sign all documents relating to the operation of the Council:
- the Director General,
- within the limits of his powers, to any employee of the Board under the authority of the Director General.

Article 13
The conditions for deputising for the General Manager are laid down in the decision referred to in Article 8.

Miscellaneous schemes

Article 14
The terms and conditions under which the staff referred to in article 100 of the amended Act of September 30, 1986 are placed under the authority of the Chairman of the French Superior Audiovisual Council are laid down in agreements between the Chairman of the French Superior Audiovisual Council and the Minister responsible for telecommunications, on the one hand, and between the Chairman of the French Superior Audiovisual Council and the Chairman of TDF, on the other.

Article 15
The lump-sum contributions provided for in article 812 of the amended law of September 30, 1986 are allocated, by way of a fonds de concours, to the State chapter in which the credits relating to the French Superior Audiovisual Council are entered.
