Deliberation of July 24, 2012 on the logical numbering of audiovisual communication services shown by terrestrial hertzian means in mainland France.

French Superior Audiovisual Council,

Having regard to Act no. 86-1067 of September 30, 1986 on freedom of communication, in particular articles 25, 30-1 and 34-4;

Having regard to the decree of December 24, 2001 on digital terrestrial television, setting out the characteristics of transmitted signals, in particular article 2;

Having regard to the decree of December 27, 2001 on the characteristics of equipment for receiving services shown on terrestrial radio;

Considering decision no. 2004-524 of December 14, 2004 of the French Superior Audiovisual Council assigning the first fourteen TV channel numbers for digital terrestrial television;

Considering decision no. 2008-451 of May 13, 2008 of the French Superior Audiovisual Council relative to the numbering of national television services shown by terrestrial hertzian means in digital mode and in high definition;

Vu la décision n° 2010-408 du 11 mai 2010 du Conseil supérieur de l'audiovisuel attribuant à la société nationale de programme France Télévisions une ressource radioélectrique pour la diffusion par voie hertzienne terrestre en mode numérique du service de télévision dénommé France Ô ;

In view of decisions no. 2009-342 of May 19, 2009, no. 2009-386 of June 9, 2009, no. 2009-403 of June 3, 2009, no. 2009-473 of June 30, 2009, no. 2009-474 of July 15, 2009, no. 2009-500 of July 15, 2009, no. 2009-587 of September 22, 2009, no. 2009-777 of November 24, 2009, no. 2009-887 of December 8, 2009, no. 2010-06 of January 7, 2010, no. 2010-07 of January 7, 2010, no. 2010-387 of May 11, 2010, no. 2011-85 of January 18, 2011, n° 2011-88 of January 18, 2011, n° 2011-94 of January 18, 2011, n° 2011-99 of January 18, 2011, n° 2011-106 of January 18, 2011, n° 2011-114 of January 18, 2011, n° 2011-119 of January 18, 2011, n° 2011-534 of June 21, 2011, n° 2011-588 of July 12, 2011, n° 2011-1227 of November 3, 2011, n° 2011-1282 of November 3, 2011 and n° 2012-445 of June 26, 2012 of the French Superior Audiovisual Council ;

Considering that, in accordance with the provisions of article 2 of the aforementioned order of December 24, 2001, the Conseil is responsible for assigning logical numbering to services shown on terrestrial radio;

Considering that it is in the public interest to have homogeneous blocks of services authorized for terrestrial broadcasting, based on their membership of a service category;

Whereas, following the call for applications launched on October 18, 2011, six new television services belonging to the national free-to-air service category have been authorized; whereas each of them must be assigned a logical number;

Whereas it is therefore in the public interest to reorganising the logical numbering of audiovisual communication services authorized to broadcast by terrestrial hertzian means, in order to bring together all national free-to-air television services shown by terrestrial hertzian means in digital mode; whereas in order not to disrupt the current organization, the numbers reserved for local television services and the numbers for television services summoning remuneration from users are increased by around ten;

After deliberation,

Decides :

Article 1

The logical numbering of audiovisuel communication services shown by terrestrial radio in mainland France is organized as follows:

a) Logical numbers 1 to 29 are reserved for national television services formerly shown in analog mode and for national free-to-air television services shown by terrestrial hertzian means in digital mode;

b) Logical numbers 30 to 39 are reserved for local terrestrial television services and additional France 3 opting-outs;

c) Logical numbers 40 to 49 are reserved for audiovisuel communication services summoning user fees;

d) Numbers 51 to 79 are reserved for high-definition diffusion of services that are simultaneously broadcast free-to-air in standard definition.

Article 2

Numbers 20 to 25 are reserved for television services authorized following the call for applications on October 18, 2011. A draw determines the order in which these services choose their logical number between 20 and 25 inclusive.

Article 3

The number allocated to each local television service corresponds to the current number increased by ten. However, a publisher may demand another number between 30 and 39, subject to availability and technical feasibility. Numbers for France 3's additional opting-outs will be allocated at a later date.

Article 4

Numbers 40 to 49 are allocated to television services summoning user fees in accordance with the appendix to this resolution.

Article 5

Article 6

The present deliberation will be effective from December 12, 2012. It will be published in the Official Journal of the French Republic.
