Deliberation no. 2024-06 of February 28, 2024 amending Deliberation no. 2015-33 of November 18, 2015 relating to the setting of rules for the sharing of the radioelectric resource for terrestrial digital terrestrial television multiplexes.
The French regulatory authority for audiovisual and digital communication,
Having regard to Act no. 86-1067 of September 30, 1986, as amended, on freedom of communication, in particular articles 22, 25, 30-1, 30-1-1, 30-2 and 30-3;
Having regard to the modified decree of December 24, 2001 on digital terrestrial television, setting the characteristics of transmitted signals;
Having regard to deliberation no. 2015-33 of November 18, 2015 of the French Superior Audiovisual Council relating to the setting of radioelectric resource sharing rules for terrestrial digital terrestrial television multiplexes;
Having regard to the responses to the public consultation of July 13, 2023 prior to the allocation of radioelectric resources for the diffusion of digital terrestrial television services in mainland France;
Having regard to the responses to the public consultation of January 25, 2024 relating to a draft amendment to deliberation no. 2015-33 relating to the setting of radioelectric resource sharing rules for DTT multiplexes ;
Considering the following:
1. The generalization of high-definition diffusion responds to the public's interest in having access to a supply of television services with increased quality, and participates in the constant movement to modernise the platform dedicated to digital terrestrial television.
2. The Authority's analyses, as well as the contributions to the public consultation prior to the allocation of radioelectric resources for the diffusion of digital terrestrial television services in mainland France referred to above and conducted from July 13 to September 29, 2023, on the one hand, and to the public consultation on the modification of deliberation no. 2015-33 referred to above, which ran from January 25 to February 8, 2024, conclude that it is possible for six high-definition channels to coexist in a nationwide digital terrestrial television (DTT) multiplex, using DVB-T and MPEG-4 norms.
3. In view of the resource that will be made available in 2025, and which will be reallocated for the diffusion of DTT services in mainland France following a call for applications, it is appropriate to make provision for the R2 multiplex, for which the entire resource will be made available and which benefits from a greater coverage than the R3 multiplex, to host up to six services shown in high definition.
After due deliberation,
Decides :
Art. 1. - Article 1 of deliberation no. 2015-33 above is amended as follows:
1° The third paragraph is replaced by the following provisions: "195 thousandths for TV services broadcast according to DVB-T and MPEG-4 standards and in HD format or 160 thousandths for, on the one hand, national metropolitan TV services broadcast on the R2 multiplex according to DVB-T and MPEG-4 HD standards when six services are broadcast on this multiplex, and, on the other hand, local metropolitan TV services broadcast according to DVB-T and MPEG-4 HD standards, other than the service shown in Ile-de-France on the national multiplex broadcasting the France 3 channel;" ;
2° The fourth paragraph is deleted.
Art. 2 - The provisions of the present resolution are applicable in New Caledonia, French Polynesia, Wallis and Futuna and the French Southern and Antarctic Territories.
Art. 3 - The present resolution will be published in the Journal officiel de la République française.
