French regulatory authority for audiovisual and digital communication,
Having regard to Organic Law no. 2004-192 of February 27, 2004 on the autonomous status of French Polynesia;
Having regard to the Electoral Code, in particular Book V ;
Having regard to Law no. 86-1067 of September 30, 1986, as amended, on freedom of communication, in particular articles 1, 13 and 16;
Having regard to Decree no. 2022-1572 of December 15, 2022 convening the electorate for the renewal of the Assembly of French Polynesia;
Having regard to deliberation no. 2011-1 of January 4, 2011 relating to the principle of political plurality in radio and television services during election periods;
Having regard to the opinion of the Government of French Polynesia dated February 2, 2023;
After deliberation,
Adopts the following notice:
On January 4, 2011, the French Superior Audiovisual Council adopted a resolution concerning radio and television services during election periods, which applies during the six weeks preceding polling day. The present notice supplements this deliberation for the election of members of the Assembly of French Polynesia scheduled for April 16 and 30, 2023.
This notice applies to all the radio and television services mentioned in point 3 from Monday 6 March 2023 until the day on which the election is held.
It does not apply to services which, exclusively accessible via online public communication, are devoted to the election propaganda of candidates or the political parties and groupings which support them.
1. Treatment of election-related news
Radio and television services shall ensure that lists of candidates and the personalities or political parties and groupings that support them enjoy fair presentation and access to the airwaves.
2. Recording of speeches
1° Radio and television editors record the contributions made by candidates, political parties and groupings and their supporters that are shown on their programs.
2° The times recorded are cumulative, for the first round, from Monday March 6 to Friday April 14, 2023 inclusive, then, for the second round, from Monday April 17 to Friday April 28, 2023 inclusive.
3. Transmission of the statement of interventions to the French regulatory authority for audiovisual and digital communication.
1° The following authorized broadcasters will transmit to the French regulatory authority for audiovisual and digital communication, by electronic means, during the six-week period preceding the first round of the election and during the two weeks preceding the second round, the statement of interventions by candidates, political parties and groupings and their supporters:
- French Polynesia La 1ère (radio and television) ;
- Tahiti Nui Television ;
- Radio 1;
- Te Reo o Tefana ;
- Tiare FM ;
- Api FM.
2° For each period mentioned below, the transmission of interventions is carried out on the following dates:
1st round of voting
Period recorded: March 6 to 17
Transmission date: March 20
Period surveyed: March 6 to 24
Transmission date: March 27
Period surveyed: March 6 to 31
Transmission date: April 3
Reporting period: March 6 to April 7
Transmission date: April 10
Reporting period: March 6 to April 14
Date of transmission: April 17
2nd round of voting
Period surveyed: April 17 to 21
Date of transmission: April 24
Period surveyed: April 17 to 28
Date of transmission: May 2
3° Other authorized publishers of local radio stations transmit to the French regulatory authority for audiovisual and digital communication, at its request and for the period it specifies, all information relating to election-related operations.
4. Retention and transmission of other information
Publishers shall keep audio or video recordings of programmes shown during the period covered by this notice, and shall provide them to the French regulatory authority for audiovisual and digital communication when requested.
This notice will be published in the Journal officiel de la République française and the Journal officiel de la Polynésie française.
