The French Superior Audiovisual Council,

Having regard to the electoral code ;

Having regard to organic law no. 99-209 of March 19, 1999, as amended, relating to New Caledonia;

Having regard to Act no. 86-1067 of September 30, 1986 as amended relating to freedom of communication, in particular articles 1, 13, 14 and 16;

Having regard to Act no. 99-210 of March 19, 1999, as amended, relating to New Caledonia;

Having regard to deliberation no. 2011-1 of January 4, 2011 relating to the principle of political plurality in radio and television services during election periods;

Having regard to the opinion of the Government of New Caledonia dated February 25, 2014;

After deliberation,

Adopts the following notice:

On January 4, 2011, the French Superior Audiovisual Council adopted a deliberation applicable to radio and television services during election periods, which applies during the six weeks preceding polling day.

The present notice supplements this deliberation for the election of members of New Caledonia's congress and provincial assemblies, which will take place in May 2014.

It applies to all radio and television services shown in New Caledonia six weeks prior to the election date.

1. Counting and transmission of statements of speaking time to the French Superior Audiovisual Council

The following service editors transmit to the French Superior Audiovisual Council, electronically, on the Saturday of each of the six weeks preceding election day, statements of speaking time for lists of candidates, political parties and groupings and their supporters:

  • Nouvelle-Calédonie 1ère (radio and television) ;
  • NC9 ;
  • NCTV ;
  • Fréquence Nord FM ;
  • NRJ Nouvelle-Calédonie ;
  • Océane FM ;
  • Radio Baie des Tortues ;
  • Radio Djiido ;
  • Radio Dynamique Sud ;
  • Radio Rythme Bleu (RRB);
  • Radio Hmelöm.

2. Obligations concerning other publishers

Other broadcasters must provide the French Superior Audiovisual Council, at its request, with all information relating to the speaking times of candidates, political parties and groupings, and their supporters.

3. Retention and transmission of other information

Publishers shall keep audio or video recordings of programmes shown during the period covered by deliberation no. 2011-1 above and, where appropriate, communicate them to the French Superior Audiovisual Council.

This notice will be published in the Journal officiel de la République française and the Journal officiel de la Nouvelle-Calédonie.
