French Superior Audiovisual Council notice no. 2017-06 of October 19, 2017 to radio and television services in view of the election of councillors to the Corsican Assembly on December 3 and 10, 2017.

The French Superior Audiovisual Council,

Having regard to the Electoral Code ;

Having regard to Act no. 86-1067 of September 30, 1986, as amended, on freedom of communication;

Having regard to Act no. 2015-991 of August 7, 2015 on the new territorial organization of the Republic;

Having regard to decree n° 2017-1464 of October 11, 2017 convening the electoral college to proceed with the election of councillors to the Assembly of Corsica;

Having regard to deliberation no. 2011-1 of January 4, 2011 relating to the principle of political plurality in radio and television services during election periods;

After deliberation;

Adopts the following notice:

Article 1

On January 4, 2011, the French Superior Audiovisual Council adopted a resolution applicable to radio and television services during election periods. The present notice supplements this deliberation for the election of councillors to the Assembly of Corsica to be held on December 3 and 10, 2017.

Article 2

The present notice applies to all national and local radio and television services, whatever their broadcasting method by any electronic communication process, from November 6, 2017 until the day on which the election is won.

Article 3

Providers of radio and television services with a national and local remit shall comply with the provisions of this notice, as set out below:

1. Treatment of election-related news :

Radio and television services shall ensure that lists of candidates and the personalities or political parties and groupings supporting them enjoy fair presentation and access to the airwaves.

2. Recording of speeches :

1°) Publishers record the speaking times of lists of candidates and their supporters, as shown on their programs.

2°) The times recorded are accumulated from Monday November 6 to Friday December 1, 2017 inclusive, then from Monday December 4 to Friday December 8, 2017 inclusive.

3. Transmission of speaking time records to the French Superior Audiovisual Council:

1°) Providers of radio and television services with a national and local remit shall provide the French Superior Audiovisual Council, at its request, with all information relating to the speaking times of the lists and their supporters.

2°) The editors of the following services transmit to the French Superior Audiovisual Council, by electronic means, during the four weeks preceding polling day, statements of the speaking times of the lists and their supporters:

• France 3 Corse ;
• France 3 Corse Via Stella ;
• France Bleu Corse Frequenza Mora ;
• Télé Paese ;
• Corsica Radio ;
• Radio Alta Frequenza.

For each period mentioned below, the transmission of speaking times takes place on the following dates:

4. Retention and transmission of other information :

Local publishers shall keep audio or video recordings of programmes shown during the period covered by the present notice and communicate them to the French Superior Audiovisual Council when requested.

This notice will be published in the Official Journal of the French Republic.
