French Superior Audiovisual Council opinion of July 19, 2011 on the draft decree amending the decree of June 24, 2011 on territorial audiovisual committees

In accordance with the provisions of articles 9 and 29-3 of law no. 86-1067 of September 30, 1986, as amended, relating to freedom of communication, the French Superior Audiovisual Council has been seized of a draft decree amending decree no. 2011-732 of June 24, 2011 relating to the technical committees provided for in article 29-3 of law no. 86-1067 of September 30, 1986, as amended, relating to freedom of communication, and has issued a favorable opinion.
Indeed, the provision whose deletion is made provision for by the draft decree, according to which members of territorial audiovisuel committees appointed to reach the number of members provided for by the decree of June 24, 2011, i.e. six members in mainland France and four to six in overseas France, will see the expiry of their term of office aligned with that of members already present, could not be applied in view of the variable expiry dates of the terms of office of members of the same committee.
It therefore seems preferable to the Board to proceed with the proposed deletion, with the term of office of new members being governed, as for those already in office, by article 11 of the decree of June 24, 2011.
