French Superior Audiovisual Council opinion of November 24, 2009 on a draft decree for the diffusion of audiovisual and cinematographic works on public channels

Avis du 24 novembre 2009 relatif à un projet d'arrêté modifiant l'arrêté du 28 novembre 2008 pris pour l'application du II de l'article 10 du décret n° 90-66 du 17 janvier 1990 modifié pris pour l'application de la loi n° 86-1067 du 30 septembre 1986 et fixant les principes généraux concernant la diffusion des oeuvres cinématographiques et audiovisuelles par les éditeurs de services de télévision.

Referred to for opinion, pursuant to article 9 of law no. 86-1067 of September 30, 1986, as amended, on freedom of communication, d'un projet d'arrêté modifiant l'arrêté du 28 novembre 2008 pris pour l'application du II de l'article 10 du décret n° 90-66 du 17 janvier 1990 modifié pris pour l'a pplication de la loi n° 86-1067 du 30 septembre 1986 et fixant les principes généraux concernant la diffusion des oeuvres cinématographiques et audiovisuelles par les éditeurs de services de télévision, le Conseil supérieur de l'audiovisuel, après en délibéré, émet l'avis suivant :

The Conseil notes that the modification to the programming schedule for long-running art house films that may be shown on Saturday evenings under certain conditions, as set out in the draft order, is the result of a provision in article 15 of decree no. 2009-1271 of October 21, 2009.

The Conseil has repeatedly emphasized the need for greater flexibility in the rules governing the times at which cinematographic works can be shown, in order to strengthen their on-air exposure.

It is therefore in favor of the draft decree submitted to it, all the more so as it should encourage greater exposure of arthouse cinematographic works at earlier times.
