Recommendation no. 2012-02 of February 14, 2012 from the French Superior Audiovisual Council to radio and television services shown in Saint-Barthélémy in view of the election of territorial councillors of Saint-Barthélémy on March 18 and 25, 2012.

The French Superior Audiovisual Council,
Having regard to the French Electoral Code, in particular Book VI;
Having regard to Act no. 86-1067 of September 30, 1986, as amended, on freedom of communication, in particular article 16;
Having regard to Decree no. 2011-1887 of December 14, 2011 convening the electorate for the election of the territorial councillors of Saint-Barthélemy;
Having regard to deliberation no. 2011-1 of January 4, 2011 relating to the principle of political plurality in radio and television services during election periods;
Having regard to the opinion of the Executive Council of Saint-Barthélemy dated February 9, 2012;
After deliberation,
Adopts the following notice:
On January 4, 2011, the French Superior Audiovisual Council adopted a ruling applicable to radio and television services during election periods, which applies during the six weeks preceding election day. The present notice supplements this deliberation. It applies to all radio and television services shown in Saint-Barthélemy with effect from the opening date of the election campaign, March 5, 2012.

1. Statements made by broadcasters and transmitted to the French Superior Audiovisual Council

The following publishers electronically transmit to the French Superior Audiovisual Council weekly statements of speaking time for candidates and their supporters:
- France Télévisions for the Guadeloupe 1re service (radio and television) ;
- Canal 10;
- Carrib'INTV ;
- Radio des Iles ;
- Radio Saint-Barth FM ;
- Radio Transat.

2. Obligations concerning other publishers

Other broadcasters must provide the French Superior Audiovisual Council, at its request, with all information relating to the speaking times of candidates and their supporters.

3. Retention and transmission of other information

Publishers shall keep audio or video recordings of programs shown during the period covered by deliberation no. 2011-1 above and, where appropriate, communicate them to the French Superior Audiovisual Council.
This notice will be published in the Journal officiel de la République française.
