In a letter dated December 10, 2003, the French Competition Council forwarded to the French Superior Audiovisual Council a copy of the complaint lodged by Iliad and Free with a view to establishing and punishing practices constituting unlawful agreements, abuse of a dominant position and abuse of economic dependence on the part of TF1, France Télécom and Métropole Télévision on various markets, and to ordering protective measures.
The French Superior Audiovisual Council (French Superior Audiovisual Council) has been asked to give its opinion in accordance with article 35 of decree no. 2002-689 of April 30, 2002 laying down the conditions for application of Book IV of the French Commercial Code, and hereby submits the following observations to the Conseil de la Concurrence.
The French Superior Audiovisual Council has limited its observations to the aspects of the dispute concerning the audiovisual industry, to the exclusion of facts and practices relating to the management of telecommunications network infrastructures, broadband Internet access and voice telephony.
