On February 17, 2022, the French National Gaming Authority (ANJ) adopted guidelines designed to clarify the conditions of application of the regulations governing the content of commercial communications by gambling and gaming operators, as well as best practice notices aimed at reducing advertising pressure in this sector and strengthening the protection of minors and vulnerable audiences in this respect.

On October 19, 2022, Arcom took note of the new legislation governing the gaming sector, as well as the guidelines and notices issued by the ANJ, and adopted deliberation no. 2022-73 on the conditions under which television, radio and on-demand audiovisual media services may show commercial communications in favor of a legally authorized gaming operator. The latter abrogates the previous deliberation n°2013-13 of the French Superior Audiovisual Council.

At the same time, it proposed that television and radio service editors strengthen their commitments made in 2011 in their respective charters of good conduct, aimed at controlling the volume and concentration of commercial communications in favor of legal gambling operators shown on their services. On November 7, 2022, television and radio service editors and their advertising agencies signed these new, updated and strengthening charters. In particular, they include the ANJ's notice limiting gambling ads to three per advertising screen.
