January 3, 2005 notice for the February 13, 2005 by-election to the Assembly of French Polynesia
Recommendation no. 2005 - 1 of January 3, 2005 from the French Superior Audiovisual Council to the national program company Réseau France Outre-mer (RFO) and the authorized audiovisual communication services of French Polynesia for the election of representatives to the Assembly of French Polynesia (Windward Islands constituency) of February 13, 2005.
In view of the electoral code;
Having regard to organic law no. 2004-192 of February 27, 2004 on the autonomous status of French Polynesia;
Having regard to Act no. 86-1067 of September 30, 1986, as amended, on freedom of communication;
Having regard to decree no. 2004-1365 of December 14, 2004 convening the electorate for the election of representatives to the Assembly of French Polynesia (Windward Islands constituency);
Having regard to the opinion of the Government of French Polynesia dated December 30, 2004;
After deliberation,
As part of its mission to ensure respect for plurality in the expression of thought and opinion, especially during election campaigns, when the requirements of a fair vote call for particular vigilance in this area on the part of all concerned, the French Superior Audiovisual Council has issued a notice to all television and radio services in French Polynesia to refrain, from January 7 to February 13, 2005 inclusive, from showing any audiovisual campaign advertising the achievements or management of a local authority in the Windward Islands constituency. This notice does not apply to the presentation, by or on behalf of a candidate, as part of the organization of his or her campaign, of the results of the management of the mandates he or she holds or has held.
This notice will be published in the Journal officiel de la République française and the Journal officiel de la Polynésie française.
