Referred to by the Government on April 23, 2013 and May 10, 2013, for a draft decree amending decree no. 2007-957 of May 15, 2007 on the digital support fund, the French Superior Audiovisual Council, meeting in plenary session on May 14, 2013, issued a favorable opinion.

However, the Conseil is concerned about the new FAN termination date, which it considers to be too soon, especially as the aid mechanisms are necessary for the smooth rollout of the new digital terrestrial television multiplexes up to June 2015.

It ensures the continuity of television services in the event of interference from foreign broadcasts or loss of reception as a result of Council decisions. Such decisions, imposing frequency changes on DTT channels, can lead to a marginal loss of reception for some households, due to the random nature of radio wave propagation. The Conseil considers that the aid scheme set out in Decree no. 2007-957, which complements its DTT planning model powers, should therefore be made sustainable.

In addition, the Conseil considers that it would be desirable to extend the benefits of the fund to local authorities benefiting from a retransmitter authorization in accordance with article 30-3 of the law of September 30, 1986, and obliged to carry out technical modifications following the implementation of Conseil decisions taken in application of articles 22, 25, 26 and 30-1 of the law, except when the expenses referred to in article 4 are covered by the spectrum reorganization fund mentioned in 9° of article R. 20-44-11 of the French Post and Electronic Communications Code.
