Opinion No. 2015-09 of June 3, 2015 on the draft decree amending the specifications of the national program company France Télévisions.
The French Superior Audiovisual Council (Conseil Supérieur de l'Audiovisuel) has been asked by the French Government to give its opinion on the draft decree amending the specifications of the national programming company France Télévisions, pursuant to Article 48 of Law no. 86-1067 of September 30, 1986 on freedom of communication. After deliberating in plenary session on June 3, 2015, the Council issues the following opinion.
The draft sent to the Council amends, for animated works, the appendix relating to the scope of rights assigned to take account of the conclusion on February 9, 2015 of an amendment to the professional agreement between France Télévisions and the syndicat des producteurs de films d'animation (SPFA) of May 27, 2014. The Board issued a positive opinion on this draft. It notes the introduction of derogatory thresholds in absolute value specific to animated works aimed at pre-school audiences, thus taking into account the particularities of their financing.
More generally, the Board has already had occasion to express its attachment to the conclusion of professional agreements between service editors and professional organizations representing audiovisual creation, and to a scheme that makes it possible to adapt the specific terms of editors' contributions to the development of audiovisual production.
