Arcom's response to the European Commission's call for contributions on tackling online piracy of live content
Introduction
The law of October 25, 2021 on the regulation and protection of access to cultural works in the digital age created the French regulatory authority for audiovisual and digital communication (Arcom), resulting from the merger of the historic audiovisual regulator, the French Superior Audiovisual Council (French Superior Audiovisual Council), and Hadopi.
The law entrusts Arcom with the task of fighting piracy of live broadcasting sporting events. Faced with the growth of sports piracy in France, the French legislature has introduced an ad hoc scheme that establishes a dynamic injunction mechanism implemented by the regulator, Arcom, which is responsible for updating blocking measures.
Arcom welcomes the opportunity offered by the European Commission to present the results obtained as part of the implementation of the law of October 25, 2021. Its experience in this area supports the finding that swift action is needed to protect the live retransmission of events, particularly sporting events. Most of the economic value associated with the live diffusion of such events is lost once they are over. At the same time, we need to ensure that blocking measures are proportionate. This is what the French scheme does, by making provision for procedural safeguards.
In responding to this call for contributions, Arcom hopes that the scheme it is responsible for implementing in France will provide a useful source of inspiration for the notice being prepared by the European Commission. While the results obtained since the scheme came into force tend to demonstrate its effectiveness, there are still a number of challenges to be met. Finally, Arcom is ready to explore, with its counterparts and the European Commission, ways of strengthening cross-border cooperation where appropriate.
