Report 2022 on the implementation of the mission to evaluate the protection measures taken by content-sharing service providers
The law of October 25, 2021 entrusted Arcom with the task of evaluating the level of effectiveness of protection measures taken by online content sharing service providers with regard to their ability to ensure the protection of protected works and objects, a mission specified byarticle L. 331-18 of the French intellectual property code.
Within this framework, Arcom can issue notices on the effectiveness of protection measures, encourage cooperation between rights holders and content-sharing service providers, and settle disputes between users and rights holders in the event of a dispute over the action taken by the service provider in response to a user's complaint.
To this end, the 2022 report on the implementation of the mission presents rights holders' assessment of the tools made available to them by content-sharing service providers, andsets out 13 notices for service providers and rights holders.
