Arcom is delighted with today's promulgation of the law aimed at securing and regulating the digital space (Sren). By adapting the European regulation on digital services (RSN) into national law, this text formalizes Arcom's designation as the authority responsible for coordinating the regulation of online platforms in France, with the aim of making them more accountable, particularly in the fight agains unlawful and harmful content.

Arcom is already involved in operational cooperation with the European Commission, and is a stakeholder in the European work to implement the RSN, notably in the context of the investigations recently launched by the Commission. Arcom will thus have all the powers required to supervise compliance by operators established in France with their obligations under European law and, more broadly, to help ensure that all digital services comply with the RSN in France and the European Union, in close coordination with the European Commission and coordinators in other countries.

It will carry out these tasks in liaison with the French national data protection agency (CNIL), with regard to the schemes protecting privacy, and the General Directorate for Competition, Consumer Affairs and Fraud Control (DGCCRF), with regard to the schemes specific to marketplaces. Agreements will be signed to formalize this cooperation.

In the coming weeks, Arcom will launch proceedings to designate "trusted flaggers", who will be responsible for submitting substantiated alerts to online platform service providers for priority processing.

Similarly, building on the close ties it has forged with the research community, notably through its study day, the third of which will take place on November 14, the Authority will approve researchers authorized to access data from online platforms, and will ensure that online platforms comply with their obligation to provide access to such data.

Drawing on its experience with the Observatoire de la haine en ligne, Arcom will deepen and broaden its cooperation with civil society to cover all issues relating to the SNS.

In this way, the Authority will apply its experience of digital regulation built up over the last few years to the benefit of this new European manager, drawing on the support of civil society and the research community.
