Draft legislation to secure and regulate the digital space: the Government proposes to appoint Arcom as "coordinator for digital services" to implement the European regulation on digital services in France.
Yesterday, the French Council of Ministers adopted a draft legislation aimed at securing and regulating the digital space, which makes provision for measures to adapt French law to the European regulation on digital services.
This regulation, adopted on October 19, 2022, provides the European Union with an innovative and ambitious regulatory manager that, while respecting freedom of expression, will make it possible to respond to the risks raised by online platforms in terms of respect for the fundamental rights of European citizens, public protection and the stability of democratic societies.
It also makes provision for each EU country to designate an independent authority to act as a "digital services coordinator", to ensure consistent implementation of the European regulation at national level.
The draft legislation to secure and regulate the digital space makes provision for this role to be entrusted to Arcom in France. Arcom would be responsible for coordinating the various competent national authorities, the French national data protection agency (CNIL), the administrative authority in charge of competition and consumer affairs, and Arcom itself; for sitting on a European Digital Services Committee; and for participating in the supervision of the very large online platforms and search engines falling within the competence of the European Commission.
At national level, Arcom would be responsible for supervising the obligations of services established in France. In the event of non-compliance with their obligations, it could issue legal sanctions, including penalty notices of up to 6% of these services' worldwide sales.
Arcom, committed to the defense of a safer Internet for all its users, is ready to fully assume the role of coordinator of digital services, should Parliament adopt the Government's proposal.
