A number of cases were referred to Arcom following the broadcast of several sequences of the "Touche pas à mon poste" show on the C8 channel in October 2022, following the murder of a young girl.

Arcom noted that, while the judicial investigation into the case was still underway, the host repeatedly made comments concerning both the conditions under which the defendant's trial was to be held and its outcome, particularly as regards the sentence to be handed down, and his psychological profile. In particular, he repeatedly summoned speedy trials and automatic life sentences in such cases.

The Authority considers that these sequences, by their repetitive nature, reflect a breach by the publisher of the obligation to deal with an ongoing court case in a measured way, enshrined in its deliberation of April 18, 2018 on the honesty and independence of news and the programs that contribute to it.

Arcom further notes that the host was able to express his opinion at length without being quickly and effectively contradicted, disregarding the obligation to respect the expression of different points of view on air on a controversial subject.

Arcom therefore served formal notice on the publisher of the C8 channel.
