French regulatory authority for audiovisual and digital communication's notice of March 30, 2022 to radio and television services concerning the legislative elections of June 12 and 19, 2022
The French regulatory authority for audiovisual and digital communication,
Having regard to Act no. 86-1067 of September 30, 1986, as amended, on freedom of communication;
Having regard to deliberation no. 2011-1 of January 4, 2011 relating to the principle of political plurality in radio and television services during election periods;
After deliberation,
Adopts the following notice:
On January 4, 2011, the French Superior Audiovisual Council adopted a resolution applicable to radio and television services during election periods. The present notice supplements this deliberation for the legislative elections scheduled for June 12 and 19, 2022.
It applies to all radio and television services, whatever their broadcasting method by any electronic communication process, from Monday May 2, 2022 until the day on which the election is won.
It does not apply to services which, exclusively accessible via online public communication, are dedicated to the electoral propaganda of candidates or the political parties and groupings which support them.
Election-related news coverage
In accordance with deliberation no. 2011-1 of January 4, 2011 on the principle of political plurality in radio and television services during election periods:
- When dealing with an electoral district concerned by the election, radio and television services ensure that candidates, personalities or the political parties and groupings that support them benefit from fair presentation and access to the airwaves;
- Where coverage of the election extends beyond the managers of the electoral districts concerned, broadcasters shall ensure that political parties and groups presenting candidates and their supporters enjoy fair presentation and access to the airwaves.
In its assessment of compliance with the principle of fairness, the Authority takes into account the representativeness of candidates, assessed in particular on the basis of the results obtained by candidates or the political parties and groupings that support them in the most recent elections to the French National Assembly and on the basis of opinion polls; the Authority also takes into account the contribution made by each candidate and the political parties or groupings that support them to animating the electoral debate.
Record of interventions
- The editors record the speaking times of candidates, political parties and groups and their supporters in all their programs.
- The times recorded are cumulative from Monday May 2 to Friday June 10, 2022 inclusive, and then from Monday June 13 to Friday June 17, 2022 inclusive.
- In French Polynesia, the times recorded are cumulative from Monday May 2 to Thursday June 2, 2022 inclusive, then from Sunday June 5 to Thursday June 16, 2022 inclusive.
- In Guadeloupe, French Guiana, Martinique, Saint-Barthélemy, Saint-Martin and Saint-Pierre-et-Miquelon, the times recorded are cumulative from Monday May 2 to Thursday June 9, 2022 inclusive, then from Sunday June 12 to Thursday June 16, 2022 inclusive.
Transmission and publication of intervention reports
- The following services electronically transmit to the French regulatory authority for audiovisual and digital communication, the breakdown of speaking times for candidates, political parties and groupings and their supporters recorded in their programs:

- Canal + for its free-to-air programs;

- RMC Story ;
- Radio France (France Inter, France Info, France Culture, France Bleu) ;
- RTL ;
- Europe 1 ;

- TV5 Monde ;
- RFI ;
- local terrestrial broadcasting services.

3° Statements sent in by national broadcasters concerning the speaking time shown during election coverage are posted on the Authority's website.
Obligations for other publishers
Other publishers provide the Authority, at its request, with all information relating to the contributions of candidates, political parties and groupings and their supporters.
Retention and transmission of other information
Publishers shall keep audio and video recordings of programmes shown during the period covered by this notice and make them available to the Authority on request.
This notice will be published in the Official Journal of the French Republic.
