Summary
Agreement or declaration?
Services shown or distributed on electronic communications networks other than those used for DTT, FM or DAB+ are subject either to the convention system or to the declaratory system.
The television publisher must sign :
- an agreement with Arcom if net annual sales exceed €150,000, or if the service is devoted to local news, whatever the sales figure.
- a declaration to Arcom in all other cases.
The provider of radio must sign :
- an agreement with Arcom if net annual sales are €75,000 or more.
- a declaration to Arcom if net annual sales are less than €75,000.
However, agreement is not required if the service consists of the complete and simultaneous transmission of :
- a channel or radio station from a national program company,
- a private TV channel or radio station with a terrestrial license, except if the effect of the takeover is to increase the population of the area served by a local TV service to more than 10 million inhabitants.
The purpose of agreements
The agreement covers advertising, sponsorship, and the production and diffusion of audiovisual and cinematic works. They also include commitments on program ethics, human dignity and child protection.
Agreements for services providing information on local life contain specific obligations.

Act no. 2006-64 of January 23, 2006 on the fight against terrorism and various provisions relating to security and border controls abolishes all prior formalities for the diffusion of non-EU channels falling within the competence of France, as well as for channels belonging to another Member State of the European Community or party to the Agreement on the European Economic Area.
