Decision of March 8, 2023 renewing the authorization of December 4, 2020 authorizing Société d'Édition de Canal Plus to use a radioelectric resource for the diffusion of Canal+.

The French regulatory authority for audiovisual and digital communication,

Having regard to Act no. 86-1067 of September 30, 1986, as amended, on freedom of communication, and in particular Article 28-1 ;

Having regard to decision no. 2020-834 of December 4, 2020 authorizing Société d'Édition de Canal Plus to use a radioelectric resource for the terrestrial hertzian diffusion, under condition of access and in high definition, of Canal+, a program with a national vocation of the Canal+ television service;

In view of decision no. 2015-420 of November 18, 2015, as amended, authorizing SA Compagnie du numérique hertzien to use a radioelectric resource for the multiplexing of programs of audiovisual communication services broadcast by terrestrial hertzian means in digital mode on the R3 network;

In view of decision no. 2022-340 of June 1, 2022 concerning the possibility of renewing, without a summons to tender, the authorization issued to Société d'Édition de Canal Plus for the terrestrial hertzian diffusion, under condition of access and in high definition, of Canal+, a national program of the Canal+ television service;

Having regard to the agreement of February 15, 2023 between the French regulatory authority for audiovisual and digital communication and Société d'Édition de Canal Plus;

Having regard to the letter dated March 3, 2023 from the publisher to the French regulatory authority for audiovisual and digital communication requesting permission for a period of 18 months;

The representatives of Société d'Édition de Canal Plus having been heard by the French regulatory authority for audiovisual and digital communication at a public hearing on June 30, 2022;

After deliberation,

Decides :

Art. 1 er. - The authorization to use the radioelectric resource held by Société d'Édition de Canal Plus pursuant to decision no. 2020-834 of December 4, 2020, referred to above, to show Canal+, a nationally-targeted program of the Canal+ television service, by terrestrial hertzian means throughout mainland France, is renewed from December 6, 2023 to June 5, 2025.

Art. 2- The Canal+ program is operated under the conditions stipulated in the February 15, 2023 agreement appended to this decision.

Art. 3- The present decision will be notified to Société d'Édition de Canal Plus and published in the Journal officiel de la République française.
