Arcom adopts amendment to Disney+ service agreement
On September 17, 2025, the French regulatory authority for audiovisual and digital communication (Arcom) adopted an amendment to the Disney+ service agreement signed on December 9, 2021.
This amendment draws the consequences of the three-year agreements signed by Disney at the beginning of 2025 with professional cinema and audiovisual organizations, and fully integrates Disney+ into a new dynamic for the circulation and availability of cinematographic works on French territory, enabling Disney+ to offer its subscribers cinematographic works nine months after their theatrical release.
Under the terms of this amendment, Arcom has reassessed the level of contribution to the production of European cinematographic and audiovisual works or original French-language works, in the light of regulatory provisions. This has been set at 25% of annual sales in France, compared with 20% for other subscription video-on-demand services subject to the law. In total, over three years, a minimum of 205 million euros will have to be invested.
In application of the legal framework, and in view of the commitments made by the publisher to the Autorité, the proportion devoted to the production of cinematographic works has been significantly increased. It is set at 50% in 2025, 53% in 2026 and 56% in 2027.
In the audiovisual field, the agreement includes a strengthening obligation for genre diversity, with at least 12% of the audiovisual production contribution obligation for animation and at least 5% for documentaries; 75% of each of these obligations will be devoted to the production of new works.
Arcom will keep a close eye on compliance with the obligations arising from the newly amended service agreement throughout the period of the agreement.
