Implementing the European regulation on digital services: Arcom, the French national data protection agency and the DGCCRF sign a cooperation agreement
On Thursday June 27, Roch-Olivier Maistre, Chairman of Arcom, Marie-Laure Denis, Chairman of the French national data protection agency (CNIL), and Sarah Lacoche, Director General for Competition, Consumer Affairs and Fraud Control (DGCCRF), signed a tripartite agreement setting out the terms of their cooperation in implementing the Digital Services Act(RSN).
The aim of this European text is to make players in the digital economy more accountable. By imposing a series of obligations to fight unlawful content and ensure transparency in the operation of algorithms, it aims to create a safer digital environment, and protect the fundamental rights of users.
Responsible for coordinating the regulation of digital services established in France, Arcom carries out its mission jointly with the French national data protection agency, for schemes protecting privacy, and with the DGCCRF for provisions specific to online marketplaces.
This agreement facilitates cooperation between the three administrations, and records the voluntary commitments made by each organization. It also sets out the terms and conditions for sharing information relating to investigations targeting regulated players and the handling of complaints from platform users.
As part of this cooperation, Arcom, which is today opening its application space for trusted flagger status, will be able to browse the French national data protection agency (CNIL) and the DGCCRF to ensure that candidate organizations meet the requirements of expertise, independence and objectivity required by the RSN.
The three signatories look forward to mobilizing their respective expertise to ensure that the regulation on digital services is properly applied, in the interests of Internet users.
