New decisive step for the European Digital Services Regulation (DSR)

Since August 25, 2023, the European Digital Services Regulation has applied to very large online platforms and search engines, each used by at least 45 million European Union citizens.

Since then, these players have been responsible for assessing and mitigating the risks involved in using their services, deploying robust moderation tools, demonstrating transparency and thus contributing to a safe, predictable and reliable online environment.

As of today, the regulation extends to all platforms operating within the Union, with obligations proportionate to their size and activity. This is a decisive step in the regulation of digital players in the European Union.

From now on, these players will have to take measures to protect person under 18s and ensure the transparency of commercial communications. The traceability of professional sellers and consumers' right to information will be strengthened on marketplaces. They will also be required to cooperate with third parties, such as trusted flaggers designated by Arcom.

Online platforms will be required to deploy mechanisms enabling Internet users to report unlawful and harmful content, to find out about the moderation measures taken, and to be able to challenge them if they feel they are unjustified.

Arcom will be responsible for overseeing compliance with these obligations by digital services established in France, in liaison with the French national data protection agency (CNIL) and the Direction générale de la concurrence de la consommation et de la répression des fraudes (DGCCRF).

Arcom will also have the task of acting as the "coordinator for digital services" provided for by the regulation in each member state.

As such, from February 19, 2024, Arcom will sit alongside the European Commission and its European counterparts on the European Digital Services Committee, responsible for ensuring that the regulation is properly applied in the European Union.
