L'Autorité de régulation de la communication audiovisuel et numérique ;

Having regard to the French Electoral Code, in particular articles L. 167-1 and R. 103-1 et seq;

Having regard to Act no. 86-1067 of September 30, 1986, as amended, on freedom of communication, in particular article 16 ;

Having regard to decree no. 2022-648 of April 25, 2022 convening voters for the election of deputies to the French National Assembly;

Having regard to the order of May 13, 2022, issued in application of article R. 103-1 of the French Electoral Code, defining the list of parties that have declared their intention to benefit from the public audiovisual communication service programs provided for in article L. 167-1 of the French Electoral Code;

Having regard to decision no. 2022-292 of May 17, 2022 relating to the conditions of production, programming and diffusion of electoral campaign broadcasts for the legislative elections of June 2022;

Having regard to the letters from the French regulatory authority for audiovisual and digital communication, sent on May 18, 2022, to the presidents of each parliamentary group at the French National Assembly, informing them of the broadcasting time available to them under III of article L. 167-1 of the electoral code;

Having regard to the e-mails sent between May 19 and May 25, 2022 by the chairmen of the parliamentary groups to the French regulatory authority for audiovisual and digital communication concerning the broadcasting times allocated to the political parties and groupings entitled to take part in the audiovisual campaign;

Having regard to the list transmitted by the Minister of the Interior of political parties or groupings entitled to benefit from public audiovisual communication service broadcasts provided for in article L. 167-1 of the Electoral Code;

Considering the following:

Article L. 167-1 of the French Electoral Code distinguishes between different lengths of broadcasting time to be allocated between the political parties or groupings entitled to take part in the audiovisual campaign; II of this article makes provision for 7 minutes of broadcasting time for the first round of voting, and 5 minutes of broadcasting time for the second round of voting, to be made available to each political party or grouping on the list referred to in III of article R. 103-1 of the Electoral Code; III of article L. 167-1 of the French Electoral Code makes provision for two hours of broadcasting time for the first round of voting, and one hour for the second round of voting, to be made available to the chairmen of parliamentary groups in proportion to their number of deputies, and for the time thus allocated to be freely distributed by the chairmen of parliamentary groups to one or more political parties or groupings mentioned on the list provided for in III of article R. 103-1 of the French Electoral Code; IV of article L. 167-1 of the Electoral Code makes provision for additional broadcasting time of one hour for the first round of voting and 30 minutes for the second round of voting to be allocated between the political parties or groupings, so that the broadcasting time allocated to each of them is not out of proportion to their participation in the democratic life of the Nation; for the breakdown of these additional broadcasting times, the same schemes make provision for account to be taken of the breakdown already made under II and III, of the representativeness of the political parties or groupings, assessed, in particular, on the basis of the results obtained at the last general renewal of the French National Assembly and at the most recent elections by the candidates or by the political parties and groupings to which they have declared their affiliation, and on the basis of indications from opinion polls, as well as the contribution of each political party or grouping to stimulating electoral debate;
