Public consultation on the perimeter of services of general interest prescribed by article 20-7 of the law of September 30, 1986 on freedom of communication
Foreword
Article 7a of Directive 2018/1808 of the European Parliament and of the Council of November 14, 2018 amending Directive 2010/13/EU of March 10, 2010 on the coordination of certain provisions laid down by law, regulation or administrative action in Member States concerning the provision of audiovisual media services (Audiovisual Media Services Directive), taking into account developments in market realities, states that "Member States may take measures to ensure appropriate visibility for audiovisual media services of general interest".
This scheme was transposed into French law in article 20-7 of the September 30, 1986 law on freedom of communication by the October 25, 2021 law on the regulation and protection of access to cultural works in the digital age.
To implement these schemes, on March 14, 2023, the Authority put out to public consultation a draft deliberation on appropriate visibility measures for services of general interest (SIG) (browse the summary of contributions received).
On the same day, Arcom also published a list of user interfaces subject to the law's obligations to ensure appropriate visibility of services of general interest (article 20-7).
The present public consultation concerns the scope of services likely to qualify as services of general interest. Article 20-7 of the September 30, 1986 law on freedom of communication stipulates in paragraph 2 of its II that: " Services of general interest are understood to be services published by one of the organizations mentioned in Title III of this law and by the TV5 channel in the exercise of their public service missions. After public consultation, the French regulatory authority for audiovisual and digital communication may include other audiovisual communication services, in proportion to their contribution to the plurality of currents of thought and opinion and to cultural diversity. It shall make the list of these services public.
In the event of an extension of the list of services of general interest, and in accordance with these schemes, Arcom is launching a public consultation to gather written comments from interested parties. The consultation covers television and on-demand audiovisual media services, as well as radio services. The legal definitions of these different service categories are given in the appendix.
Responses to the consultation must be submitted electronically by July 13, 2023 at the latest.
Responses will be considered public and may be published on the Arcom website, with the exception of elements for which confidentiality is explicitly demanded.
