At the Cannes Film Festival, Arcom spotlights the financing and protection of audiovisual creation

To mark the 75th edition of the Cannes Film Festival, Arcom has issued a reminder of the rules governing channel and platform contributions to the financing of creative work, and has clarified the scheme that applies in the fight against piracy.

At the 75th Cannes Film Festival, Denis Rapone, Chairman of the "Protection and diffusion of sports-related content and creation" working group, and Jean-François Mary, Chairman of the "Audiovisual, cinematographic and musical creation and production" working group, explained Arcom's missions in the fight against piracy, and in the protection and financing of creation, at round-table discussions organized in conjunction with the Centre national du cinéma (CNC).

 

Channels' and online platforms' contributions to financing creation

TV channels are required to contribute to the production of French and European films. One of Arcom's roles is to ensure compliance with the obligations to broadcast and finance imposed by law on audiovisuel players. Generalist DTT channels must invest between 3.2% and 3.5% of their sales in the production of European cinematic works, including 2.5% for EOF films alone. In 2020, 343 million euros were paid out to the film industry, in particular to finance 130 films. On Wednesday April 6, Arcom published the declarations of 21 television services subject to the law on contributions to cinematic production.

On-demand audiovisual media services (ADMS) are subject to exhibition and prominence quotas, as well as obligations to invest in the production ofcinematic and audiovisual works. On Thursday December 9, Arcom signed agreements and notified the obligations of the main SMADs established in other European Union member states and offering their cinema and audiovisual supplies on the French market: Netflix, Disney +, Amazon Prime Video, for its contract service, and Apple App - iTunes Store.

In Cannes, on Saturday May 21, Arcom's College Advisor Jean-François Mary took part in a major debate entitled "Channels and platforms in the financing of creation: diversité et souveraineté", moderated by SACD Managing Director Pascal Rogard, with speakers including Damien Bernet, Director of Netflix, Karine Blouet, General Secretary of the M6 Group, Florence Gastaud, Head of Production, Wild Bunch, Christophe Tardieu, General Secretary of France Télévisions, Rosalie Varda, Ciné Tamaris/ Mk2 and Salima Yenbou, Member of the European Parliament.

Protecting creativity and fighting piracy

On Sunday May 22, Denis Rapone, advisor to the Arcom college, opened the CNC debate entitled "Protection de la création : Nouvelle régulation, nouvelles opportunités", during which Pauline Blassel, Arcom's deputy general manager, and Cécile Lacoue, CNC's director of studies, statistics and forecasting, presented the situation in the fight against sports-related and cultural content piracy in figures.

Freedom of information and fighting misinformation in the digital age

Carole Bienaimé Besse, Arcom's College Advisor, who chairs Arcom's "Education, audience protection and social cohesion in audiovisual and digital media" working group and vice-chairs the "Audiovisual, cinematic and musical creation and production" group, took part in meetings and debates with French audiovisual attachés abroad on freedom of information and the fight against disinformation in Cannes on Friday May 20. She stressed the need to step up systemic regulation of platforms, alongside other foreign regulators.
