The French regulatory authority for audiovisual and digital communication,

Having regard to Organic Law no. 99-209 of March 19, 1999, as amended, relating to New Caledonia ;

Having regard to Organic Law no. 2025-1055 of November 6, 2025 aimed at postponing the general renewal of the members of the Congress and the Provincial Assemblies of New Caledonia, in order to allow discussions leading to a consensual agreement on the institutional future of New Caledonia;

Having regard to the electoral code ;

Having regard to Law no. 86-1067 of September 30, 1986, as amended, on freedom of communication, in particular articles 1, 13, 14 and 16;

Having regard to deliberation no. 2011-1 of January 4, 2011 relating to the principle of political plurality in radio and television services during election periods;

Having regard to the opinion of the Government of New Caledonia dated May 27, 2026;

After deliberation,

On January 4, 2011, the French Superior Audiovisual Council adopted a resolution applicable to radio and television services during election periods, which applies during the six weeks preceding polling day. The present notice supplements this deliberation for the election of members of the New Caledonian congress and provincial assemblies to be held on June 28, 2026. It applies to all radio and television services authorized in New Caledonia from June 1, 2026.

1. News coverage of the election

In accordance with deliberation no. 2011-1 of January 4, 2011 on the principle of political plurality in radio and television services during election periods:

  • When dealing with an electoral district concerned by the election, radio and television services ensure that lists of candidates, personalities or the political parties and groupings that support them benefit from fair presentation and access to the airwaves;
  • Where coverage of the election extends beyond the managers of the electoral districts concerned, broadcasters ensure that political parties and groupings presenting lists of candidates and their supporters benefit from equitable presentation and access to the airwaves.

In its assessment of compliance with the principle of fairness, Arcom takes account of the representativeness of candidate lists, assessed in particular on the basis of the results obtained by candidates, candidate lists or the political parties and groupings supporting them at the most recent elections to the Congress and the provincial assemblies of New Caledonia, and on the basis of indications from polls of voting intentions; Arcom also takes into account the contribution made by each of the lists of candidates and the political parties or groupings that support them to the electoral debate.

2. Statement of interventions

The following radio and television services transmit to Arcom, by electronic means, statements of the speaking times of the lists of candidates, political parties and groupings and their supporters:

  • Nouvelle-Calédonie La 1ère (radio and television) ;
  • Caledonia ;
  • NC9 ;
  • Fréquence Nord FM ;
  • NRJ Nouvelle-Calédonie ;
  • Océane FM ;
  • Radio Baie des Tortues ;
  • Radio Djiido ;
  • Radio Rythme Bleu (RRB);
  • Radio Hmelöm.

They transmit according to the following schedule:

3. Transmission of other information

Radio and television broadcasters provide Arcom, at its request, with all information required for the investigation of any submissions of a case before the court, in particular airtime.

For a period expiring four weeks after the end of the period of application of the present notice, radio and television services shall keep at Arcom's disposal recordings of programmes shown during the period of application of the notice. This notice will be published in the Journal officiel de la République française and the Journal officiel de la Nouvelle-Calédonie.
